Dispute on Fair Use

Wikipedia claims that since this picture is a picture of an existing building, that it does not have valid fair use. However, there is no other way to get a replacement of the picture as it is a main picture of the school and the only way to replace it would be to take another picture, which would still fall under the category of invalid fair use. In addition, this image is not copyrighted in any way by the school, the NYC Department of Education, the government (city, state, or federal), or any individual. In fact, the image was on www.facebook.com, which requires that users who upload pictures upload non-copyrighted pictures and when they upload it they surrender all rights of ownership to the picture, making this picture fair use and possibly public domain. Fair Use Rationale for Staten Island Technical High School

This image has fair use rationale to be used in Staten Island Technical High School because

  1. It is a main picture of the school's building and contributes significantly to the article.
  2. The NYCDOE, the city and state government, the school itself, nor anybody else has any copyrights on this photo (though Wikipedia considers pictures of an existing building to not be valid fair use.
  3. It is a scaled-down, low resolution picture.

Source provided is not the copyright holder. (Facebook is filled with clearly (c) images). As initial source is unknown, it is impossible to ascertain the actual (c) holder. As the building still exists, it should be easily possible to provide non-questionable (c)-status image. SkierRMH (talk) 07:37, 29 November 2007 (UTC)
